These General Terms and Conditions (GTC) apply to all purchases, bookings and reservations made via the website www.messnerhof.net. The version valid at the time of the order is authoritative.

The presentation of products and services on the website does not constitute a legally binding offer but an invitation to place an order. By submitting an order or booking, you make a binding offer. The contract is concluded as soon as you receive a confirmation by e-mail.
All prices stated are in euros and are final prices including statutory value added tax (IVA). Shipping costs are shown separately during the ordering process.
Payment is made via the payment service provider Stripe by credit or debit card. The charge is made at the time of the order or booking.
The purchase of alcoholic beverages is permitted exclusively to persons who have reached the age of 18. By placing an order, you confirm that you are at least 18 years old.
The shipment of wine orders is possible to selected European countries. The countries currently served, the shipping costs and the delivery times can be viewed on our "Shipping" page.
For logistical reasons, certain islands and special territories are excluded from shipping — in particular the Mediterranean and Atlantic islands, overseas territories and customs exclusion zones (e.g. Livigno, Campione d'Italia, Heligoland). The complete list of excluded delivery areas, broken down by country and postcode, forms part of these GTC and is published on the "Shipping" page.
Shipment is carried out in break-proof packaging. We accept no liability for delays for which the commissioned shipping service provider is responsible.
Upon delivery, the goods must be checked for integrity. Should the packaging show visible damage, please accept the delivery only subject to reservation and note this on the carrier's delivery slip.
Alternatively, the order can be collected free of charge at the winery by prior appointment.
As a consumer, you have the right, pursuant to the Italian Consumer Code (Legislative Decree 206/2005, Art. 52 ff.), to withdraw from the contract within 14 days without giving reasons. The withdrawal period is 14 days from the day on which you or a third party designated by you took possession of the goods. In the case of collection at the winery, the period begins with the taking over of the goods.
To exercise your right of withdrawal, you must inform us (Bernhard Pichler, St. Peter 7, I-39100 Bolzano, e-mail: info@messnerhof.net) by means of a clear statement of your decision to withdraw from the contract.
Consequences of withdrawal: We will refund all payments received from you, including the costs of (standard) delivery, without delay and at the latest within 14 days of receipt of your withdrawal declaration. You bear the direct costs of returning the goods. We may withhold the refund until we have received the goods back or you have provided proof that you have returned the goods, whichever is the earlier.
(If you wish to withdraw from the contract, you can fill out this form and return it to us — its use is not mandatory.)
Booked experiences (wine tastings, picnics, guided tours) are leisure-time services for a specific date; pursuant to Art. 59(1)(n) Legislative Decree 206/2005 there is no statutory right of withdrawal for them. The following cancellation conditions apply:
Decisive is the receipt of your cancellation by e-mail to info@messnerhof.net.
Weather and force majeure: If a weather-dependent experience (e.g. picnic, guided tour) cannot take place due to unsuitable weather, we will, where possible, offer you an equivalent alternative (e.g. indoors) or a replacement date; a cash refund is excluded. If we cancel the experience, the amount paid will be refunded in full.
The holiday apartment is registered under the Italian national identification code (Codice Identificativo Nazionale, CIN) IT 0210 08B5 T8WY NNOC.
Bookings of a holiday apartment for a specific date are excluded from the statutory right of withdrawal (Art. 59(1)(n) Legislative Decree 206/2005). The following graduated cancellation conditions apply:
Decisive for the calculation of the period is the time of receipt of your cancellation declaration (by e-mail to info@messnerhof.net) in relation to the day of arrival.
A wine sponsorship is a one-off service for the chosen term; it is paid once and does not renew automatically. The respective product description provides information about the services associated with the sponsorship.
Membership in the "Messnerhof Weinfreunde" programme is free of charge and takes place via the double-opt-in procedure. It is voluntary, can be cancelled at any time and does not give rise to any payment obligation.
The statutory warranty rights apply. For defects in delivered goods there is a warranty obligation of 24 months from delivery pursuant to Art. 128 ff. Legislative Decree 206/2005.
Should goods arrive damaged or defective, please contact us at info@messnerhof.net with a photo of the damage. After examination, we will offer you a full refund or a replacement.
The operator may offer time-limited promotions, discount codes, vouchers and membership programmes (e.g. "Messnerhof Weinfreunde"). The following principles apply:

The law of the Italian Republic applies. The place of jurisdiction is the District Court of Bolzano (Tribunale di Bolzano), insofar as legally permissible. Mandatory consumer-protection provisions of the state in which the consumer has his habitual residence remain unaffected.
Pursuant to Art. 141 ff. of the Italian Consumer Code (Legislative Decree 206/2005), we are obliged to inform consumers about the possibility of out-of-court dispute resolution. We are currently neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions remains unaffected. The statutory provision takes the place of the invalid provision.
